Please contact stallion owner for breeding contract to verify information. We encourage every bidder to contact stallion agent/owner PRIOR to bidding to confirm contract stipulations.

The breeding will sell under terms expressed in Stallion owner’s current year service contract, except when in contradiction with that of NSBA. In that case, the NSBA contract will take precedence.

WITNESSETH:
In consideration of one dollar and other good and valuable consideration, we the owners of the stallion recorded above, sell, transfer, and assign to NSBA, a breeding service for the year 2024, to the above named stallion. It is expressly understood by all parties to this agreement that this breeding service is assignable only by NSBA, pursuant to the terms and conditions of the Incentive Fund Program for the year in which said breeding applies, said terms and conditions being incorporated here in by direct reference thereto. All parties to this agreement are further bound and agree to all of the following terms and conditions:

  1. The stallion services will be sold at 75% of the advertised breeding fee between October 1, 2023 and October 31, 2023. Any breeding not sold during that time will be available for purchase from November 2, 2023 through June 30, 2024 for 50% of the advertised breeding fee plus $100 administrative fee.
  2. The breeding will sell under the conditions as set forth in the NSBA Stallion Service Auction breeding contract completed by stallion owner or agent. NSBA acts only as agent in this sale and will not be responsible for accident, sickness, or death to any stallion, mare and/or foal. This contract will supersede and the mare owner’s payment to NSBA is in acceptance of these terms.
  3. Should the stallion die or become unfit for breeding purposes and the mare has not been serviced by said stallion, then any monies paid by mare owner to NSBA shall, upon verification, be given credit to purchase another available stallion service during the current auction or during the following year’s auction. If a credit balance remains from a difference in price, a refund will be given for the difference.
  4. The successful bidder of a stallion service must use the breeding during the current breeding season. If the mare does not take, the mare owner is entitled to one rebreed the following year.
  5. All purchased breedings are non-transferable to another person.
  6. Bid prices do not cover additional fees associated with the transaction between the bidder and the stallion owner or breeding facility.
  7. It is the bidder's responsibility to fully understand all fees outside of the bid price, including but not limited to chute fees, shipping fees, mare care, and veterinarian care. These additional fees will be paid by the winning bidder directly to the stallion owner or breeding facility and vary by stallion. Bidder is responsible for contacting the stallion owner or breeding facility to get information on any additional fees associated with the stallion breeding. Stallion owner and mare owner hold NSBA harmless in the event of a published error of fees.
  8. Bids are binding. Once submitted, your bid becomes a binding contract and promise to pay. Bids may not be retracted once submitted. There will be no refunds of winning bids for any reason. If a stallion dies or becomes unfit for service a credit towards another available stallion during the current auction or the following year will be given. After purchase has been completed, any transaction dealing with the breeding will be solely between the stallion owner and the mare owner.
  9. When the stallion service is sold, the stallion and mare owners will receive one copy of NSBA’s breeding contract with the name of the mare owner inserted.
  10.  Upon sale of Stallion Service, the stallion owner is entitled to a complimentary membership and foal enrollment into the Incentive Fund for a foal of the current breeding year. The membership is automatically issued as ownership is listed for the stallion.
  11. The mare owner will receive a complimentary foal enrollment for the resulting foal into the Incentive Fund.

NSBA is not responsible for any statements made by the stallion owner or breeding facility or for any actions taken by the stallion owner or breeding facility before, during, or after completion of the auction. NSBA is not responsible for any other business conducted between the stallion owner or breeding facility and the winning bidder. All breedings are sold as is, where is, with no warranty expressed or implied. NSBA makes no guaranty as to the quality or outcome of the breedings. NSBA shall not be liable for any damages of any type or nature (whether in contract, tort or otherwise) sustained or claimed by any bidder, person or entity in connection with the auction.
